Antara dokumen yang biasa dikenakan Duti Setem di Malaysia termasuk:<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Perjanjian Jual Beli Hartanah (SPA)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Perjanjian Pinjaman dan Pembiayaan<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Borang Pemindahan Saham<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Perjanjian Sewa atau Pajakan<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Akuan Berkanun dan Kontrak Pekerjaan<\/span><\/li>\n<\/ul>\n<h2><b>Mengapa Setem Penting Dari Segi Undang-Undang?<\/b><\/h2>\n<p class=\"translation-block\">Tujuan utama membayar Duti Setem di Malaysia adalah untuk memastikan dokumen tersebut boleh diterima sebagai bukti di mahkamah. Mengikut Seksyen 52 Akta Setem, dokumen yang tidak dimeterai tidak boleh digunakan dalam prosiding undang-undang. Selain itu, pegawai awam seperti hakim atau pendaftar mempunyai kuasa untuk menahan mana-mana instrumen yang tidak dimeterai dengan betul.<\/p>\n<h2><b>Memahami Kadar Duti Setem<\/b><\/h2>\n<p class=\"translation-block\">Kadar Duti Setem di Malaysia berbeza bergantung kepada jenis transaksi. Secara umum, terdapat dua jenis kadar:<\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\" class=\"translation-block\">Duti Tetap (Fixed Duty): Jumlah tetap yang tidak berubah walaupun nilai transaksi berbeza. Contohnya, RM10 bagi Akuan Berkanun.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\" class=\"translation-block\">Duti Ad Valorem: Cukai yang dikira berdasarkan nilai yang dinyatakan dalam dokumen, seperti harga rumah atau jumlah pinjaman.<\/li>\n<\/ol>\n<h2><b>Contoh Pengiraan: Pemindahan Hartanah<\/b><\/h2>\n<p class=\"translation-block\">Bagi pemindahan hartanah menggunakan Borang 14A, kadar Duti Setem adalah seperti berikut:<\/p>\n<ul>\n<li aria-level=\"1\">1% bagi RM100,000 pertama<\/li>\n<li aria-level=\"1\">2% bagi jumlah seterusnya sehingga RM500,000<\/li>\n<li aria-level=\"1\">3% bagi jumlah seterusnya sehingga RM1,000,000<\/li>\n<li aria-level=\"1\">4% bagi jumlah melebihi RM1,000,000<\/li>\n<\/ul>\n<p class=\"translation-block\">Bagi sebuah rumah bernilai RM500,000, duti setem adalah RM1,000 (RM100,000 pertama) + RM8,000 (RM400,000 seterusnya), menjadikan jumlah keseluruhan RM9,000.<\/p>\n<h2><b>Tempoh Masa dan Penalti Lewat Bayaran<\/b><\/h2>\n<p class=\"translation-block\">Masa adalah sangat penting dalam pengurusan duti setem di Malaysia. Dokumen yang ditandatangani di Malaysia mesti disetem dalam tempoh 30 hari dari tarikh pelaksanaan. Jika ditandatangani di luar negara, tempoh 30 hari bermula apabila dokumen tersebut diterima di Malaysia.
