Ia adalah cukai tidak langsung peringkat tunggal yang dikenakan ke atas perkhidmatan bercukai tertentu oleh orang berdaftar dalam urusan perniagaan.<\/p>\n<p>Hanya perkhidmatan yang disenaraikan dalam Jadual Pertama, Peraturan Cukai Perkhidmatan 2018 boleh dikenakan cukai ini \u2014 memastikan keadilan dan kejelasan bagi perniagaan serta pengguna.<\/p>\n<h2><span style=\"text-decoration: underline;\"><b>Skop Cukai Perkhidmatan<\/b><\/span><\/h2>\n<p>Di bawah Seksyen 9 Akta Cukai Perkhidmatan 2018, cukai dikenakan ke atas:<\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\" class=\"translation-block\">Penyediaan perkhidmatan bercukai oleh orang berdaftar di Malaysia;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\" class=\"translation-block\">Perolehan perkhidmatan bercukai import oleh mana-mana orang di Malaysia;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\" class=\"translation-block\">Perkhidmatan digital oleh penyedia luar negara kepada pengguna Malaysia.<\/li>\n<\/ol>\n<p>Walau bagaimanapun, Cukai Perkhidmatan tidak terpakai di kawasan yang diwartakan sebagai Kawasan Ditetapkan (Designated Areas, DA) dan Kawasan Khas (Special Areas, SA):<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\" class=\"translation-block\">Kawasan Ditentukan (DA): Labuan, Langkawi, Tioman, Pangkor.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\" class=\"translation-block\">Kawasan Khas (SA): Zon bebas, gudang berlesen, kilang berlesen, dan Kawasan Pembangunan Bersama (JDA)<\/li>\n<\/ul>\n<p>Perkhidmatan eksport juga dikecualikan daripada cukai perkhidmatan.<\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"text-decoration: underline;\"><b>Definisi Orang Bercukai<\/b><\/span><\/h2>\n<p>Menurut Seksyen 12, orang bercukai ialah mana-mana individu atau entiti yang menyediakan perkhidmatan bercukai seperti yang ditetapkan,<\/p>\n<p><span style=\"font-weight: 400;\">termasuk:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Individu (termasuk pengarah)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Syarikat \/ perniagaan<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Perkongsian atau kelab<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Badan amanah, koperasi, persatuan<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Penyedia dalam Jadual Pertama tertakluk kepada cukai.<\/p>\n<h3><b>1\ufe0f\u20e3 Perkhidmatan Domestik<\/b><\/h3>\n<p class=\"translation-block\">Penyedia yang mencapai ambang nilai jualan mesti mengenakan cukai perkhidmatan 6%.<\/p>\n<h3><b>2\ufe0f\u20e3 Perkhidmatan Import<\/b><\/h3>\n<p>Mana-mana pihak yang memperoleh perkhidmatan dari luar negara mesti mengisytihar sendiri dan membayar cukai melalui borang SST-02A sebelum akhir bulan berikutnya.<\/p>\n<h3><b>3\ufe0f\u20e3 Perkhidmatan Digital (Penyedia Asing)<\/b><\/h3>\n<p>Perkhidmatan digital bermaksud sebarang perkhidmatan yang dihantar atau dilanggan melalui Internet atau rangkaian elektronik, yang dijalankan secara automatik dan bergantung kepada teknologi maklumat (contohnya: penstriman, perisian, langganan).<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\" class=\"translation-block\">Cukai Perkhidmatan dikenakan atas nilai yang dibilkan oleh orang berdaftar asing kepada pengguna di Malaysia.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\" class=\"translation-block\">Cukai menjadi kena dibayar apabila bayaran diterima oleh orang berdaftar asing tersebut.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\" class=\"translation-block\">Jika dikenakan kepada perniagaan yang berdaftar, perniagaan tersebut boleh menuntut bayaran balik dengan menolak Cukai Perkhidmatan Digital yang telah
