简介

《Labuan 商业活动税法案》(LBATA) 是马来西亚一项关键的税务法规,专门管辖 Labuan 实体。根据该法案,凡从事 Labuan 商业活动的实体,须依据 LBATA 纳税;而未涵盖在内的实体,则需根据《1967年所得税法》纳税。

什么是 纳闽 (Labuan) 商业活动?

Labuan 商业活动是指在 Labuan 内部、从 Labuan 出发或通过 Labuan 进行的贸易或非贸易活动,但不包括任何在马来西亚法律下属违法的活动。

实质要求

若实体要受 LBATA 管辖,必须从事 2018年实质要求法令 [PU(A) 392/2018] 所列的业务,例如:

  • Labuan 保险人、再保险人、伊斯兰保险/再伊斯兰保险公司
  • Labuan 银行、投资银行、伊斯兰银行
  • Labuan 租赁或伊斯兰租赁
  • Labuan 信托公司
  • Labuan 国际大宗商品贸易公司
  • Labuan 基金经理、管理人或证券持牌人
  • 控股公司(纯股权或非纯股权)
  • 其他如行政、薪资、法律或会计等服务

若实体从事的活动 不在此清单内,将适用《1967年所得税法》,而非 LBATA。
